The purpose of these General Terms and Conditions of Use (hereinafter the "GTCU") is to define the conditions of use of the website https://stoparasites.vetoquinolusa.com/(hereinafter "the Site").
Consultation and use of the Site by any user (hereinafter the "User") implies acceptance of the GTCU and is therefore governed by them.

 

1. IDENTIFICATION

The Site is published by VETOQUINOL S.A., a public limited company with share capital of €29,704,755, headquartered at Magny-Vernois, 70200 Lure, France and registered with the Registre du Commerce et des Sociétés de Vesoul/Gray under number 676 250 111 (hereinafter "Vetoquinol").

2. SITE PURPOSE

The Site is reserved for the User, veterinarian or veterinary clinic staff. It allows free consultation of information on Vetoquinol products and news, and access to downloadable services, documents and tools.

The information presented on the Site does not constitute a veterinary consultation and is not intended to establish a diagnosis; the information presented on the Site is not intended to replace a veterinary consultation or diagnosis.

3. LINKS TO OTHER SITES

3.1. Links to other websites proposed on this website do not form part of the website https://stoparasites.vetoquinolusa.com/.

3.2. Vetoquinol is not responsible for the content of other websites linked to this site, nor for any damage that may arise from the use of such websites.

4. WEBSITE ACCESS

4.1. Consultation and use of the website requires the following conditions on the part of the User:

- availability of Internet-capable equipment,

- availability of Internet access,

- acceptance of GTCU.

4.2. Consultation and use of the Site are subject to the creation of a personal space. Access to the personal area is systematically conditional on entering the e-mail address given when the personal area was created and the password defined by the User. These identifiers are strictly personal and the User is responsible for taking all necessary measures to protect their confidentiality. Any access to the Site using the User's identifiers is deemed to be attributable to the User.

5. ACCEPTANCE OF GTCU

5.1. Any User wishing to use the website must read the Terms and Conditions.

5.2. Consultation and use of the webite are subject to the User's explicit acceptance of the GTCU.

5.3. Vetoquinol reserves the right to modify and update the GTCU at any time and without notice, it being specified that the applicable GTCU are those in force on the date of the last update specified above.

6. USE OF THE WEBSITE

6.1. The User undertakes to :

- Use the site solely for its intended purpose,

- Use the site in compliance with the GTCU.

The User undertakes not to make his personal space accessible to a third party in any way whatsoever.

6.2. Vetoquinol reserves the right to modify or delete the content of the Site or to suspend or terminate access to the Site.

7. DELETE USER ACCOUNT

7.1. The User may delete his personal space at any time, directly from the Site under the heading "My Account" or by requesting Vetoquinol to do so by filling in the contact form. This deletion is definitive..

7.2. Vetoquinol reserves the right to delete the User's account without notice in the event of a breach of the GTCU by the User, without the User being able to make any claim whatsoever. Vetoquinol may exercise this right without prejudice to its right to claim damages to compensate for any loss suffered as a result of the User's breach of the GTCU.

8. OPTIONAL SERVICES

8.1. The User may subscribe to the newsletter set up by the Site in order to receive free electronic information concerning Vetoquinol products and news, as well as personalized documentation.

8.2. The User may unsubscribe from the newsletter at any time, directly from the Site under the heading "My Account" or by clicking on the link provided for this purpose and present in each information e-mail sent to the User.

9. VETOQUINOL'S LIABILITY

9.1. Vetoquinol shall not be liable for any direct or indirect damages (including lost profits or lost data) resulting from access to or use of the Site or any information contained therein, regardless of the nature of such damages. Vetoquinol declines all responsibility for the appropriateness of decisions and the methods of their execution, as chosen by the User solely on the basis of the information and results published on the Site.

9.2. Vetoquinol declines all responsibility in the event of damage suffered by the User, in particular as a result of the loss, deterioration or alteration of files, or the transmission of viruses that may infect his/her computer equipment or any other property when connecting to and/or consulting and/or using the Site. It is the User's responsibility to take all appropriate measures to protect his or her data and equipment from contamination by viruses or attempted intrusion into his or her computer system by third parties via the Site.

9.3. The User acknowledges that the technical reliability of data transmission on the Internet is relative and that data is not protected against possible misappropriation. Under these conditions, the communication of confidential information and, more generally, of any personal data, is made by the User under his/her sole responsibility.

9.4. The User acknowledges that Vetoquinol cannot be held responsible for Internet network operating conditions that may affect access to or use of the Site, and in particular for Internet network access, availability and throughput problems that may prevent or significantly slow down access to the Site and affect response times for displaying, consulting, querying or transferring data.

9.5. The User acknowledges that he/she is solely responsible for his/her equipment being connected to the Internet and that Vetoquinol cannot be held liable for any damage that may occur during connection.

9.6. Consequently and with full knowledge of the foregoing, the User waives Vetoquinol's liability for one or more of the aforementioned facts or events.

10. USER WARRANTIES

10.1. The User agrees to indemnify Vetoquinol, as well as any person involved in the creation and development of the Website, free of charge and without prejudice for any claims, liabilities, costs and expenses resulting from the breach of these GTCU or related to the use of the Website.

10.2. The User undertakes to enter only accurate data on the Site. All information and data are transmitted by the User under his/her sole responsibility, and the User agrees to indemnify and hold Vetoquinol harmless against any direct or indirect damages resulting therefrom.

10.3. The User shall be solely liable for any direct or indirect, material or immaterial damage or injury caused by the User to Vetoquinol as a result of the use or misuse of the Site. In the above cases, the User agrees to indemnify and hold Vetoquinol harmless, including reasonable attorney's fees that Vetoquinol may incur in connection with any claim for damages.

11. INTELLECTUAL PROPERTY

11.1. With the exception of data entered by the User, the Site and all its component parts, in particular all articles, computer programs, databases, visual elements, texts, graphics, photographs, images, trademarks, logos, creations and various copyrightable works, whether registered or not, and more generally all information appearing on the Site, are the exclusive property of Vetoquinol or of third parties with whom the latter has concluded agreements allowing exploitation.

11.2. Vetoquinol grants the User a non-exclusive, strictly personal and non-transferable license to use the Site in accordance with its intended purpose.

11.3. The User has no rights to the site, with the exception of an exclusive right of use. In particular, the User has no right of reproduction, distribution or, more generally, exploitation in any way whatsoever, without the express prior authorization of Vetoquinol.

11.4. Vetoquinol reserves the right to take legal action against any infringement of the site and its component parts.

12. MAINTENANCE

Vetoquinol will use its best efforts to monitor and correct any bugs that may affect the operation of the Site.

13. SITE AVAILABILITY

13.1. Vetoquinol will use its best efforts to ensure that the site is accessible 24 hours a day, 7 days a week.

13.2. The site may not be accessible in particular in the event of force majeure, breakdown or maintenance operations that may be carried out by Vetoquinol at any time, without prior notice.

14. APPLICABLE LAW AND JURISDICTION

14.1. These GTCU and any dispute or claim arising out of or in connection with the GTCU or their subject matter shall be governed by and construed in accordance with French law.

14.2. The User and Vetoquinol agree that any dispute or claim arising out of or relating to these GTCU (including non-contractual disputes or claims) shall be submitted to the jurisdiction of the courts of Vesoul, France.
